1. Acceptance of Terms

By downloading, installing, or using AstraFit (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you should not use the App. Velchi AI reserves the right to update these Terms at any time, and your continued use of the App constitutes acceptance of those changes.

2. Use of the App

You must be at least 18 years old to use the App. The App is intended for personal, non-commercial use only. You agree to use the App in accordance with these Terms and any applicable laws and regulations. 

AstraFit does NOT provide medical advice, diagnosis, treatment, or health services of any kind. The App's features and tools are intended for information purpose only focusing on encouraging active lifestyles, fostering positive habits, and promoting general well-being. For specific health concerns or medical guidance, users should consult a qualified healthcare professional. 

AstraFit is NOT intended for individuals who are seeking medical advice in any form. All information provided in the application is for fun, entertainment, and general wellness purposes only.  While AstraFit strives to provide useful and accurate information, the content within the App may be inaccurate, outdated, incomplete, or unreliable. Users should not rely on the content as medical advice and should verify any information before taking any action. AstraFit is not liable for any decisions, actions, or consequences arising from the use or reliance on the content within the App.

Users are strongly encouraged to consult qualified healthcare professionals if they have any underlying physical or medical conditions (e.g., heart disease, respiratory issues, past injuries, chronic illnesses, mental health conditions, overuse injuries, etc., but not limited to). This app is not recommended for any individuals with such conditions, those under the age of 18, or pregnant women. 

While the App offers tools and guidance to assist users in reaching their fitness or health goals, we do not guarantee that users will achieve the intended or expected results. Individual progress varies depending on multiple factors including but not limited to personal effort, consistency, and medical conditions. The App does not promote that users will necessarily achieve their specific goals or results, and is not responsible if users are unable to meet their goals. 

Upon uninstalling the App, all associated data, including but not limited to rewards, user progress, and locally stored information, may be permanently lost. We are not responsible for the loss of any data or progress when the App is uninstalled. While certain data may be stored on your device (such as progress or reward points), we cannot guarantee the preservation of this data after uninstallation or if the app is removed from your device for any reason.In the event of reinstallation, previously stored data may not be restored unless specifically stated within the App's features or policies. We are not liable for any loss of data, rewards, or progress resulting from uninstalling or failing to back up your information.

A. General Guidelines

• Violence and Harmful Content:
  We do not permit any form of violent, abusive, or harmful content within the app. Users must refrain from uploading, sharing, or engaging in any activity that promotes harm or violence towards individuals or groups.

• Nudity and Explicit Content:
  AstraFit does not allow the sharing or display of explicit content, nudity, or any sexual content. All users must respect the app's guidelines regarding the submission and sharing of such content.

• Hate Speech and Discrimination:
  The app prohibits content that promotes hate speech, racism, sexism, discrimination, or any content that attacks, insults, or discriminates against any individual or group based on race, ethnicity, gender, religion, sexual orientation, or other characteristics.

• Harassment or Bullying:
  AstraFit fosters a safe and supportive environment for all users. Harassment, bullying, and any form of abusive behavior will not be tolerated.

B. User-Generated Content

• Responsibility for Content:
  Users are solely responsible for any content they generate, upload, or share within the app. By submitting content, users affirm that they own the content or have permission to share it. 

• Reporting Violations:
  If you encounter content that violates these guidelines or feel unsafe, you can report it directly to us at [velchiai@gmail.com] for prompt review and action.

C. Disclaimer of Liability for Content

• Limitation of Liability:
  Velchi AI is not responsible for any damages, losses, or consequences arising from interactions with or use of user-generated content within the app. We reserve the right to remove content that violates our terms of service or any applicable laws.

D. Age Restrictions for Health Content

• Content Suitable for Mature Audiences:
  Some features of the app, especially those related to diet, nutrition, and fitness, may include content that is more suitable for mature audiences. These features are not intended for children under the age of 18. Parental discretion is advised.

3. User Accounts

To access certain features of the App, you may be required to create an account and provide personal information, including your name, email address, and password. You are responsible for maintaining the confidentiality of your account information and for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Please note that multiple user accounts are not permitted within the App. Creating multiple accounts on the same device may result in the termination of your account. 

4. Data Collection and Privacy

We collect and store personal and non-personal data as detailed in our Privacy Policy. By using the App, you consent to the collection and use of this data. You can review our Privacy Policy for more information. Additionally, your data is stored locally on your device, and the app is not responsible for retaining any user data upon uninstallation. Uninstalling the app will result in the loss of all locally stored data, and the app disclaims any responsibility for data loss in such cases. 

5. AI and GPT-Generated Content

The App uses artificial intelligence (AI) and GPT-based technologies to provide personalized content, including fitness recommendations, nutritional advice, and other features. While we strive to provide accurate and helpful information, you understand and agree that the content generated by AI may not be entirely accurate or suitable for your specific needs. You should consult a qualified professional before making any significant health or fitness decisions.

6. In-App Purchases

The App may offer in-app purchases for additional content or features. All purchases are final and non-refundable unless otherwise required by law. Prices and availability of in-app purchases may change without notice. Uninstalling the application will result in the loss of any purchases and reward points associated with your account. If you reinstall the App, your previous purchases and reward points may not be restored unless specifically stated by the App's policies or terms. 

7. Advertisements

The App may display video advertisements, banner advertisements, or other forms of advertising. Users acknowledge and agree that, in some cases, they may be required to watch or interact with advertisements before gaining access to certain features or content within the App. By using the App, you agree to view these advertisements as part of your experience. The App has no control over the content, nature, or accuracy of third-party advertisements and disclaims any responsibility or liability for any issues, claims, or consequences arising from the display of such advertisements.

8. User Content

You may have the ability to create, submit, or share content within the App, including but not limited to exercise logs, nutritional data, and personal achievements ("User Content"). By submitting User Content, you grant AstraFit and Velchi AI a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, distribute, and display such content in connection with the operation of the App.

You agree not to submit any content that is illegal, offensive, or violates the rights of others. We reserve the right to remove any User Content that violates these Terms.

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Velchi AI and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our express written consent.

10. Limitation of Liability

The App is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the App, including but not limited to the accuracy or reliability of any content. To the fullest extent permitted by law, we disclaim all liability for any damages arising out of or in connection with your use of the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless AstraFit ( Velchi AI ), its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Indiana, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Indiana, USA.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.
